A - SECURITY DEPOSIT
Upon signing the vacation lease, the TENANT shall remit the sum of two thousand dollars ($2,000) as a security deposit, by way of a cheque made payable to Via Capitale Partenaires In Trust, hereinafter referred to as the TRUSTEE.
Upon signing the lease, the TRUSTEE shall deposit the cheque into a trust account, where it shall remain until disposed of in accordance with this clause. The purpose of the deposit is to guarantee the TENANT's obligation to return the PREMISES, including furniture and accessories, in the condition in which they were received, subject to normal wear and tear, reasonable use, or force majeure, and to ensure payment of any outstanding amounts owed to the LANDLORD under the lease, including any utilities or expenses that are the TENANT's responsibility.
The LANDLORD shall have 15 days following the end of the lease to verify that all obligations covered by this clause have been fulfilled. In the event of non-compliance, the LANDLORD must notify the TRUSTEE in writing not to release the deposit to the TENANT. If no notice is given within this timeframe, the TRUSTEE shall return the deposit to the TENANT. Otherwise, the TRUSTEE may only dispose of the deposit in accordance with written instructions from both parties or by court order.
B - RENT
The rent shall be paid by the TENANT as follows:
Upon signing of the vacation lease: The first month's rent is payable, along with the $2,000 security deposit.
Upon taking possession of the premises (November 15, 2025): The remaining amount due at that time, corresponding to 50% of the total lease amount, shall be paid.
January 15, 2026: The final 50% of the total lease shall be paid.
C - NO SMOKING
Smoking is strictly prohibited inside the house.
D - PETS
No animals are allowed in the house, except for the possible acceptance of a dog, which will be considered on a case-by-case basis, at the sole discretion of the LANDLORD. An express written agreement must be signed between the TENANT and the LANDLORD if a dog is to be allowed.
In case of breach of this clause, the security deposit will be forfeited and no further justification will be required.
E - CLEANING
The TENANT is responsible for having the premises professionally cleaned at the end of the stay.
